CONDITIONS OF TENDER
1. Prospective purchasers must rely on their own personal inspection and knowledge of the property independent of any representations made by or on behalf of the Vendor.
2. Tenders must be received at the address above on or before 4:00 p.m. on Friday, July 31, 2026.
3. Envelope containing tenders must be clearly marked ?TENDER?.
4. Tenders must be accompanied by a $10,000.00 deposit cheque payable to Sims Law Corporation. Deposits accompanying unacceptable bids will be refunded.
5. Highest or any tender not necessarily accepted.
TERMS AND CONDITIONS OF SALE
6. The bidder whose tender is accepted will be required to complete an agreement covering terms and conditions of sale.
7. The closing date of the sale shall be Sunday, November 1, 2026 or the end of the 2026 crop season and/or as agreed upon between the Vendor and Purchaser, on which date the Vendor shall provide a registrable Transfer of title and the Purchaser shall pay the balance of the accepted tender or provide evidence that the balance will be available under conditions acceptable to the Vendor. If the balance is not paid in accordance with these conditions, the deposit may be forfeited as liquidated damages and not as a penalty.
8. Possession is not authorized until acceptable arrangements for full payment are made following acceptance of tender.
9. Mines and minerals will be reserved from any tender.
10. The successful bidder will be responsible for real property taxes commencing January 1, 2027.
