156.22 total acres (as per Property Assessment Report)
Civic Address: 123022 PR 355, RM of Oakview.
Including House (1440 sq ft, 3 bedrooms, 1.5 bath) with attached (1220 sq ft) 2 car Garage and farm outbuildings (including farm shop/barn) and livestock facilities located on the property.
CONDITIONS OF TENDER:
1. The owner makes no representations with respect to the property.
2. Prospective purchasers shall rely on their personal inspection and knowledge of the property, and not on the above or any other particulars or representations made by or on behalf of the Sellers.
3. Written tenders shall be received on or before 5:00PM on January 3, 2025, at the address listed above.
4. Envelopes containing tenders must be clearly marked ?TENDER?.
5. Highest or any tender not necessarily accepted. Seller reserves the right to evaluate offers and may accept or reject any or all offers at their sole absolute discretion.
TERMS AND CONDITIONS OF SALE:
1. A deposit cheque in the amount of 10% of the tender price shall accompany the tender payable to ?Sims & Company? which will form the deposit on any successful tender. Deposits accompanying unaccepted bids will be refunded.
2. The balance of any accepted tender shall be paid within 30 days from the date of the notification of tender acceptance, or evidence provided that the purchase funds will be available under conditions acceptable to the Seller. If the balance of the accepted tender is not paid within the set time limit, the deposit may be forfeited as liquidated damages and not as a penalty.
3. The bidder whose tender is accepted will be required to complete an Agreement covering the terms and conditions of the sale.
4. The Closing date of the sale shall be negotiable to a mutually agreeable date between Seller and Purchaser on which date the Sellers shall provide a registerable Transfer of Land to the Purchaser and the Purchaser shall pay the balance of the accepted tender. If the balance of the accepted tender is not paid within the set time limit or acceptable arrangements for payment have not been made, the deposit paid will be forfeited as liquidated damages and not as a penalty.
5. Adjustments for real property taxes shall be December 31, 2024. Purchasers will be responsible for the 2025 real property taxes.
6. All land is sold subject to existing utility and other caveats or right-of-way agreements registered against title.
7. All mines and minerals shall be retained by the Seller.
8. All land shall be sold subject to any mines & minerals caveats. Surface rights leases associated with mines & minerals shall be assigned to the Purchaser.
9. Seller reserves the right to evaluate and select offers based on the Seller?s own internal criteria and to accept or reject any offer submitted in Seller?s sole and absolute discretion.
10. Successful bidders will be responsible to pay GST or to provide a GST Declaration and Undertaking to Self-Assess if registered for GST.
11. All leases on the land will terminate on accepted Closing date.
