My daughter was just in an accident on 18th and richmond today around noon June 5th. She was established in the intersection turning left. Someone ran the light but since there werent any witnesses they are giving her 50/50.. The other guy said he had a green light. We are looking for anyone who witnessed this accident to contact us.. There was someone walking who called the police, but they left the scene..T Please contact us if you were there.

Just because he had a green light (which is possible since drivers run the yellow instead of giving drivers like your daughter the chance the clear the intersection) doesn't give him the right to hit her. What kind of stupid excuse is that?? If he was looking where he was going he would have seen her, and given her the chance to clear the intersection. If a pedestrian was crossing when he had a green light can he just run into them? Can't believe they are holding her 50% responsible. I come to Brandon several times a month, and the people that run the yellow are horrible.

I'm shocked that it outrages you that MPI are giving this 50/50 responsibility and if the light was green there's a chance she would get 100% at fault so it sounds like she is lucky (because there is no witnesses) that she is only getting half responsibility.  
I've been on the receiving end of MPIs "bad" decision making when deciding who is at fault for an accident.  
It's unfortunate that your daughter had to go through this. You can be the most careful driver on the road but there's always going to be idiots causing accidents that are unavoidable.  
I sometimes get annoyed at drivers turning left in an intersection that drive through a red light but I also understand. They establish themselves in the intersection when the light is green (as they have a right to do so) but they are worried to go untill oncoming traffic is completely stopped because there's always that one idiot that tries to beat the light and cause an accident (like what sounds to have happened in the case of your daughter)  
Good luck in trying to find a witness but I'd say this one might have to be chalked up to a life lesson for your daughter.  
If she's established in the intersection and traffic's is still moving as the light goes amber, I'd say wait until everyone is completely stopped before trying to make your turn.

Long ago the same situation happened to me. I was told by the police that the ones turning left in a controlled intersection must always yield to the oncoming traffic. ...Even when the light turned red or is turning red. The left turning vehicles clear the intersection last and only when safe to do so. So in theory, even when crossing traffic is violating the signal and proceeds to illegally enter the intersection against the signals, the driver turning left must wait until it's all clear. I was eventually cleared of wrong doing only because several witness statements indicated the the light was red for several seconds and that the cross traffic from the other direction were proceeding to start entering as I was completing my turn.  
 
Today, with better tech. the dashcams can remove doubt for cases like these where the red light runner never made any attempt to stop or what the signal was at during the collision. Cars produced today should come standard with this option. It's funny the automakers will place cameras and sensors in every direction for every situation, but one. ...and without a way to record. Should be as mandatory and common place as daytime driving lights and photo radar. The guilty get proven wrong and that's, that.  
 
Just my opinion, I could be wrong.

I hope you are able to find a witness or two. Why would anyone else comment on fault or blame unless you directly saw the accident. There is no way to tell what happened unless you were there or there is video evidence. That is why it is currently 50/50.

Hey sorry I just need to clarify, the light was amber. The oncoming driver pushed through the amber light before she could get out of the intersection, but when the police showed up they "said" it was green. There were a few people around who witnessed it, one person even stopped by and asked her if everything was alright but then left.

where a dashcam would of been the well worth the cost.  
 
Ya, manufacturers have a backup camera standard in many vehicles. Just add a forward camera, link the forward and backup to a recording system that saves to a removable SD card.

As per the Manitoba Driver's Handbook:  
 
Once established in the intersection, you may clear the intersection when it’s safe and if:  
there’s no pedestrian traffic crossing the lanes you wish to turn into, there’s a break in traffic big enough to complete your turn safely without interfering with oncoming vehicles, and no other vehicles are approaching  
If the light turns yellow or red while you are established in the intersection, watch for traffic slowing down to stop and complete your turn when it’s safe. Always be alert to drivers attempting to race an amber light. (If you are not already established in the intersection, you must not attempt the left turn when the light changes from green.)  
 
Sorry but she's lucky she wasn't placed 100% at fault.

The exact same thing happened to me in December as I was turning left.  
I was pretty sure the light would be red by the time he hit me because I remembered thinking the car before him was rushing the red. BUT they were going to put 100% blame on me! bc he said he had green. A couple friends/fam encouraged me to research and stick it out - I did and mpi found him at 100% fault.  
I sat and observed the lights and watched the timing (I wanted to make sure I was right; I believe if one is at fault should admit to it) - I was even more convinced I was not at fault.  
I went to couple of the businesses on the corners and asked. And posted on here - someone came forward!  
I also stuck it out with total loss unit and got the amount I wanted. Even getting some physio from mpi because it jolted me enough to cause discomfort (and it's good to get on issues asap so they don't set in). This is why we pay into mpi!  
I also prayed a lot and learned a few lessons, including.... now when turning left I make sure everyone is stopped completely before moving through.  
If she believes she is in the right, tell her to stick it out!

I know someone this happened to a few years ago only he was the one going through. The light turned yellow and he hit the car that was in the Intersection completing its turn. Turns out the turning car was driven by an off duty police officer. The attending officer told the driver of the through car that once the light turned yellow he should not have entered the intersection, that the turning car had the right to complete its turn at that point. He-the through dtiver-was given 100% blame. So-for those of you now saying that in this case the driver of the turning car is lucky not to get 100% blame-you are very wrong. (Unless of course you want to say that in the earlier instance that I mention favoritism was given to the turning driver because he was a law enforcement officer ?) Sounds like the exact same situation, except in that case I describe the through driver admitted the light turned yellow as he entered the intersection. In this case, the through driver is lying and saying he still had a green light.

1/2 correct . The car should not of entered the intersection on a yellow light, But the turning vehicle may only complete its turn when safe to do so. It must yield to oncoming traffic.  
I do believe there may have been a favour given to the off duty officer.  
This same situation happened to-my buddy two years ago in Winnipeg and the person turning was the only one charged.
