Hi people of Brandon, I’m in hopes that someone will be able to help me! I was in an accident on Friday February 21st. It happened on 18th street and Park Ave around 4:40pm. I was on Park Ave about to turn left onto 18th street going south, the turning signal stated to blink so I proceeded to go. There was a vehicle across the street, so as I turned, I made sure to go into the first available lane (left lane). As I just rounded the corner, I could see this vehicle out of the corner of my eye starting to come into my lane. She had turned right from the other side of the street, and came directly into my lane, not into her first lane. Once she hit me, I had stopped, and was about to assess the damage, and she proceeded to pull ahead into the left lane and proceed to drive away. So, I started to follow her to make sure to get her information if I needed to file a claim. I followed her until she finally pulled over into the Keystone Parking lot (five blocks away) where we both got out and exchanged information. Unfortunately, she is now trying to say that I took the turn wide and hit her. Which is false. I’ve tried calling around if anyone has cameras, so I’m hoping someone was in the area, or having supper at pizza hut, and saw. If you did, please please contact me! Thanks in advance!

If you had the green turn signal, she had a red light. Should not really get past that. You have the right of way. You cannot turn right on a red light until it is clear.  
 
Hope you find a witness. But in the meantime she turned on a red light when it was not clear. If it was clear no accident.

Wrong. Problem is everyone in brandon assumes they can turn into the far lanes, when you can’t. So although the individual made a right hand on a red, because opposite traffic LEGALLY needs to turn into their closest lane it is considered clear to travel. Unfortunately OP will need to find a witness stating the other vehicle made an illegal turn by not turning into their closest lane.

If the other vehicle did not stop after the collision then it should be reported to the police . It is an offence not to stop.

MPI has experienced adjustors that can tell who hit who. Go there and see what they say

You are correct about which lane. Wrong otherwise. If it was two greens you are correct. Green arrow vs red light is different.  
 
When you have a red light it is your responsibility to turn only when it is clear. If you hit something it was obviously not clear. Car, pedestrian whatever. The green flashing arrow is right of way over a red light. Red means stop. Most Brandon drivers don’t seem to realize that one either.

Yes red means stop for oncoming traffic, the oncoming traffic legally needs to turn into their closed lane.. so it is considered clear to travel. If what you’re saying was the case MPI would be blaming the right light driver for turning on a red light, which they aren’t because you can turn on a red light. They need to find out who turned illegally by pulling into the furthest lane.

It's illegal to make a right turn at an intersection when a green left-arrow is shown with a red light, even if there's no sign indicating a right turn is prohibited on a red light. Under no circumstances are you allowed to turn right or drive straight through when a green left-arrow is illuminated with a red light.

Above is info that many drivers do not seem to know or ignore. Saw the same thing today. Truck turns right @ dairy Queen as I am turning left from Park onto 18th with a green arrow for me.

UMM No not true, In Manitoba you are allowed to turn right at a red light after making a full stop and only proceeding when safe  
 
In this instance , Both vehicles can legally go since there is THREE lanes at that intersection, The person Turning Left should have turned into the left most lane, the one closest to the meridian (which they said they did)  
 
The person turning Right should have been clear to go as well since they should have turned into the bus lane (as long as there is no bus, the lane should always be clear since it starts at park) Of course they also have to yield to pedestrians. they then need to merge into the right travel lane before the end of the block.  
 
Obviously one of the drivers (or both) made a mistake and honestly since there are THREE lanes here my guess it was the one turning right, hopefully there is a wintness or sometimes MPI investigators can assess the damage in a way that tells them what happened  
 
Red — Stop in front of the marked crosswalk or, if there’s no marked crosswalk, before the sidewalk out of the way of pedestrians and vehicles. Unless a sign shows otherwise or vehicle/pedestrian traffic does not permit, you may, after stopping completely, turn right. You may also turn right or left from a one-way street to another one-way street.

Just go and let the guys in the shop do their job. They can usually tell by placement of damage who was at fault. Then go from there on whether you need a witness. As for continuing to drive the police do not attend unless injury or fluids leaking from vehicles, so not impending traffic and pulling in somewhere safe is what’s to be done. At least that’s what happened to me when tboned in an intersection two years ago

The bus lane should never be used by non-bus traffic with the only exception being making a right turn at the next available turn. (This doesn't mean next intersection like many drivers seem to believe, it means NEXT AVAILABLE right-turn)  
 
In this 3-lane scenario you described the driver making the right turn onto 18th ST should be entering the middle lane, which is the most right-hand lane designated for regular traffic.

What you have stated is Correct for a Normal intersection with a red light. However, as in many cases,there are exceptions to the rule.  
What you missed is the fact that if a red light and a GREEN arrow are showing, then you can not turn right until the green arrow disappears,,as stated in the Driver's handbook:  
 
"It's illegal to make a right turn at an intersection when a green left-arrow is shown with a red light, even if there's no sign indicating a right turn is prohibited on a red light. Under no circumstances are you allowed to turn right or drive straight through when a green left-arrow is illuminated with a red light."

To clarify some of the misinformation that has been presented here:  
 
From the HTA:  
Green arrow or green arrow with red light  
88(9)  
When a green arrow traffic control light or a green arrow in conjunction with a red traffic control light, is shown at an intersection by a traffic control signal,  
 
(a) the driver of a vehicle at or approaching the intersection and facing the traffic control light or green arrow  
 
(i) may enter the intersection to make only  
 
(A) the movement indicated by the arrow, or  
 
(B) a U-turn if the green arrow indicates a left turn and there is no traffic control device prohibiting the movement, and  
 
(ii) shall yield the right-of-way to other traffic lawfully within the intersection or within a crosswalk adjacent to the traffic control signal;  
 
Also, from the Driver Handbook:  
 
Turning Right onto a Reserved Lane:  
If you’re turning right onto a street with a  
Diamond Lane in the curb lane, you must  
turn as close as practicable to the curb and  
into the first lane. You should then signal,  
check and change lanes out of the Diamond  
Lane into the adjacent lane as soon as it’s  
safe to do so. If you’re driving parallel to a  
Diamond Lane and need to turn right, you  
can enter the Diamond Lane but you must  
turn right at the next intersection. Always  
be watchful and respect the rights of  
cyclists using the Diamond Lanes.  
 
To the OP:  
The Eastbound vehicle should have turned to the curb lane, providing there was not a green arrow illuminated, in which case they should not have turned at all.  
Hopefully you can find a witness.  
You will still need to see an Estimator and hopefully they can assist.

Ah yes i forgot the hi-way traffic act say "only vehicle allowed in the intersection" when there is a flashing turn light. Honestly IMO most intersections that rule isnt needed, and I have never heard of a ticket for such a turn but you are right technically illegal in that instance  
 
I would also say that MPI doesn't necessarily find fault only with who was legally wrong but with who could have prevented the accident, even if the other person was in the wrong you are required to try and avoid accidents. Where the car was hit will tell the adjuster a lot
