So when a rare event like a landlord actually gets the " Tenancies blessing " of an eviction to happen... I know it's for serious reasons that has not been said ( yet ) in this discussion.
Vermin and mold? Yes, that's usually a sign or result of neglect. But by whom? That's a tricky one. Many bad tenants hide behind the rights and privacy laws/bylaws and abuse them at it's fullest extent. I had my battles with that many times. Often, they refuse entry until I can provide legal reasons (like the annual fire/smoke detector inspection) only for them to continue hiding inside and not reply to calls/texts/email/letters/posted bulletins or simply knocking on the door. Yeah, I completely understand why landlords would let themselves in when tenants hide inside and "play possum" for weeks on end. It's called a vacancy or an condition check after when all means of communications fail with the tenant. So, because of the tenants neglect and reluctance/resistance to allow entry, the landlord is often blamed for the poor living conditions of the unit even though they were never informed of any problems until the Tenancies Branch gets involved. Yeah, I've had that happened once too many times.
In all of my time, I never encountered or heard of an tale where both the Rentalsmen and the landlord were both in the wrong. PAULSAPHER, I can't believe your story. You've created a situation brought on by you that has been proven by the landlord to the Residential Tenancies Branch and a judgement made of your actions/inactions that resulted an eviction order. Stop playing the victim. The real victim is the landlord and this has already been proven by the law. We, as landlords, already know that your landlord is not finished being a victim. There's the clean-up and repairs, the vacancy time that will occur and probably that landlord will "eat all those cost" (even when there's a payment order set against you) as direct result from your bad habits & lifestyle and most likely of your financial irresponsibility before/after moving out. And even if anything of what you've said is true.... Why would you want to remain there? You've made it clearly that the living conditions are unsatisfactory and the terrible landlord is against you in continuing to live there. The vacancy rate is wide open here in town, so what gives? Was it the rent rate, the location, or the landlords certain flexibility that you took advantage on ? ...or was it the fact that you're now inconvenienced by being forced out?
Just move on and don't cause yourself or the landlord any more grief, if you are the better person.
