Ticket scalping

What is the possibility of e-Brandon not posting tickets for sale if they are above the original issue price. I think it is scalping as far as the law is concerned, see how much trouble Ticketmaster is in over this issue. I have been checking for Country fest tickets and almost everyone is scalping the tickets.
What does everyone else think????
