Is this legal or not?

A family members had a job interview at a local gas station as the gas bar attendant, at the interview the manager clearly stated he won't hire my family member based on their smoking habit. Claiming he has hired smokers before who tend to just smoke during the job hours, and that he is not looking to hire a smoker!!
I find that Rude and I think it's against the law!?
