New York Rangers seeking compensatory draft pick after prospect's death

Many no doubt know the unfortunate story of Russian prospect Alexei Cherepanov's death after collapsing during a KHL game in Russia last month.
I was reading on ESPN this afternoon that the New York Rangers (the NHL team that drafted him and owned his rights) are requesting a compensatory draft pick from the NHL on the basis that he is technically eligible to be drafted again next year. NHL teams by the league's rules are normally awarded a new draft pick as compensation if they are unable to sign a first round pick and that pick goes back into the list of draft-eligible players.

Should this be a case where the Rangers should get a pick as if they did not sign Cherepanov, or should they be making special considerations because of the situation?
