deleting a facebook user who has passed away...

can ANYONE tell me how to delete a user who has past away? My brother past away and no one has his password to delete his account. I and many family members have sontacted facebook and they said it would be deleted asap. It has been 4 months and still on there. Some people have wrote nasty comments on his wall and WE NEED IT CLOSED! Any ideas? Thank you.
