Sole Murder or Double Homicide?

"Aysun Sesen's parents believe they lost two children Tuesday morning, when their pregnant daughter died from stab wounds and her fetus was stillborn.
But under the law, Sesen's husband, Turan Cocelli, was charged only with the murder of his wife. The seven-month fetus is not considered a human being in the eyes of the law.
"Yes, there should be two charges," said Besey Sesen, 53, Aysun's father.
Through an interpreter, he added: "I told police officers this is two bodies, two murders. ... I feel like my heart is broken into pieces."

Should this be a double homicide? What do we think?
And, since an unborn child is considered not a human with no rights, should drinking while pregnant and so on remain legal?
