Children makes no difference when it comes to property division. It's still 3 years to split it down the middle.

They were acquired during their cohabitation

I thought of this thread when reading another paper.  
 
"My husband is jealous of my dog, but never hurts him. He just ignores him, even when he begs for attention, and I hate my husband for that. Don't tell me to get rid of my useless husband as there's too much money involved in this farm and I'd rather wait him out. But back to the dog issue, what if I just bring a puppy home?"  
 
Better to wait it out then divorce. More money involved. Lol.

Ok. What I have been told, must be wrong.  
Whether it is six months, one year or three years, it still makes sense to have a prenup. The value involved in something as simple as the "partners" vehicles can run into ten's of thousands of dollars and that's before one even begins to count any home, property business, income or pensions etc.  
The whole idea of a prenup is to have it in place before you begin to cohabit which in turn, should void any disputes on legal time frames.  
No doubt some lawyer's will still argue it though.

I am for pre-nups. If you are with a person because you want that person, then you shouldn't feel threatened or intimidated by not being "entitled" to thier stuff if you split up later or if there are things they want to leave to thier children from previous relationships.

Keep in mind folks that a cohabitation agreement applies exclusively to non-marital relationships, a cohabitation agreement cannot function as a prenuptial agreement. The terms of a cohabitation agreement will no longer have effect if common-law spouses marry.
