Car thief caught in act ...or?

On the Wpg news a car thief was allegedly caught in the act by a group of people. Pictures were posted on a blog showing the alleged car thief on the ground with cuts and bruises. The group stated, along with racial remarks, that he must have fell and hit his head on their boots. The police are still investigating. Should the group be charged with hate crimes or did they stop an all too frequent crime?
Thoughts?
