I haven't done a vehicle inspection since before the current regulations were put in place. At that point in time we, as inspectors, were advised to contact vehicle standards if a vehicle that was being inspected appeared to have a higher level of tint than it should. They would come and check the window tint to see if it was too much and make the decision to pass or fail the vehicle.
The equipment to test the window tinting is rather expensive so all the individual inspection stations were not required to have that equipment. I don't know if that is still the case today, but regardless of that, the regulations still have window tint levels as part of the inspection. In some cases I'm sure a judgment call is made.
If people are being fined for having too much window tint on a vehicle that has a fresh inspection, it's not because the safety inspection regulations aren't there. They are. The problem lies in the hands of those doing the inspections and / or those people that are overseeing the safety program.
