Hello, I am hoping someone can help me and may have seen this just before 5 pm today.  
 
Backed out of a parking spot, put into drive and started to drive ahead when all of the sudden this blue Honda Pilot pulled out from the other side and backed into my vehicle. My horn was going to warn him but he didn’t stop until he realized he couldn’t move anymore and pulled back in. We were yelling out the window as well but he said he didn’t hear and said he has a backup camera as well. I took pictures of all of it and wanted pics of his license but he was on his phone speaking a different language. Finally got a picture of his license and the damage on both vehicles. He is trying to say it was not his fault after calling someone a second time. It was snowing as well and plenty of people around so hoping someone seen this. Any help would be appreciated.

All parking lot accidents are 50% fault of both parties.

It doesn’t matter who is at fault, parking lot accidents are 50/50.

If you were driving in lane way and he was trying to enter it’s 100% on him. You can even drive into someone backing out and since there trying to enter the lane way its their fault. Mpi will figure it out by the location of the damage on the vehicles.

A parking lot is not a lane way and MPI usually deems parking lot accidents as 50/50 fault unfortunately, unless that’s changed Recently.

As it turns out, based on the damage location and I was already in drive, not my fault!

From the sounds of it, it wasn’t your fault at all, but at the end of the day it all boils down to what MPI thinks and considering it happened in a parking lot, you might be surprised at the out come. Good luck though, hopefully it works out for you.

I called and reported it to MPI and based on the circumstances and location of the damage I’m not at fault at all. Guess that’s what they mean when they say ‘pictures are worth a thousand words’ I feel better knowing that.

Yep, I was going to say that I have only been in one accident in my life: it was in a parking lot and I was found 100% at fault!

I am not at all sure what your point is here nor do I know your circumstances at the time of your incidents.

They were agreeing with you that not all parking lot accidents are 50 50 and some can be found to be 100% against one person.

Sorry if I wasn't clear. Yes, as popgoestheweasle said, I was agreeing that parking lot accidents are NOT always 50/50 at fault. So you shouldn't just accept that, and should provide all evidence to MPI so that they can determine who is at fault.  
My source: I was 100% at fault for a parking lot accident.

In my case last March Break, I was driving in parking lot to find place to park and a vehicle backed out causing damage to my vehicle along the side of my passenger side. Response from driver was I guess I didn’t see them...not my job to look at every parked vehicle to make sure they don’t back out without looking. Exchanged info, made claim and never paid a nickel towards the $4,200 damage to my vehicle. Good luck!

I'd be a little hesitant to step forward as a witness after that comment to people who were just trying to give you help and advise.

The OP was just looking for some help and advice but some of the comments here were of no help at all. Example,

Seriously, all accidents. Of the thousands of parking lot accident in Manitoba in 2017, all were 50-50. What kind of help is that. How could anyone know how MPIC would deem who is at fault in thousands of accidents. Comments like that are of no help at all. The OP just wanted a little assurance that it wasn't their fault and seeking possibly a witness or two.  
So here is my two cents worth. I'm pretty sure that not all accidents in parking lots are 50-50, and I'm pretty sure that a person backing up and runs into to someone in the travel lane, that the person backing up is at fault.

Please read the thread in its entirety before passing judgement and making this into something it is not.
