A friend of mine is suddenly moving to another province to look after after her terminally ill parent. She just started working for a corporation in the hospitality industry for 7 weeks, can she leave her position suddenly without ramifications towards pay owed?

All they can do is hold the pay for two weeks... the company has to pay for hours worked

Not giving notice is crappy to the employer, but the employer can’t do anything about it. They have to pay your friend for all hours worked (within 10 business days). Your friend likely shouldn’t use them as a reference though...and the employer likely won’t ever hire them again if they come back in a year or whenever seeking employment there.

case hopefully the employer understands the reason for such a departure since it's a family situation. I think taking care of a terminally ill parent takes a little more priority The person when getting the job likely don't plan on having to leave the province on such short notice. So if the employer has a heart, they would fully understand the situation.

Does she like her job? I only ask because if she’s going to take care of a sick parent than she can try for a leave of absence, for compassionate care. Now this only works if there is a high possibility of her living 6 months or less, sad but the government recognizes this and she can than apply for compassionate care leave. She will however need a doctors note from her mother’s physician with her diagnosis

I think you have to work for the same employer for 90 days to receive compassionate care leave ... but would be worth looking into.

The input was very helpful. No matter the circumstances are it is a quality of life move for her. She did offer partime to assist the company that way she has the extra time to prepare to move. Will see what the employers decision will be for the part time hours.
