Anyone ever sued for liability? Any recommendations for a lawyer? Any possibility of them being having their insurance policy cancelled? Will their premiums increase?  
I fell while helping a family member-could be off long term. It is my own family member that is suggesting I Sue for liability. I'm interested in hearing experiences

Your family member is encouraging you to sue them? Or to sue another family member?

Makes me think I should never again ask for someone to help me out of the goodness of their heart, which is why I do favours for others, because I care!

I'll share my experience of being sued for liability.  
 
Long time ago (12 years ago) a kid stole my vehicle and got into an accident with it. He turned around and sued the people he crashed into, me, the people renting from me, and the previous owner of the other vehicle - let's remember that he STOLE my vehicle.  
 
His lawyer put the claim in for a million per person ( 7 people = 7 million total).  
My insurance company refused to cover the lawyer fees at first, had to higher another lawyer to fight my insurance company to cover the lawyer fees.  
 
There went $40,000.  
 
3 years later, I had to pay for the legal fees of the other vehicle owner and their drivers because they counter sued me because I was NEGLIGENT in letting my vehicle get stolen resulting in the lawsuit against them. There went 85,000$ to cover their legal fees.  
 
A couple more years later and now more than $200,000 in the hole, the thief is willing to settle, but only after having to put a claim in against the insurance company, destroying my retirement savings, losing everything so a thief who still enjoys bungee jumping, 4 wheeling and everything else reckless can cash in.  
Also, the cost of hiring a private detective (2000$ every few months to document evidence of so called unable to work again injuries)  
 
So - for you wanting to sue and displace the urge to sue by saying your family wants you too - I hope you enjoy the lives you destroy. I hope you get sued as a result and you experience every dreadful experience of it in return.

It's an awful system adopted from the Americans many years ago. If a third party wants compensation for damage/injury that was caused and/or happened on/from another's property, most property insurance will only pay out only if an amount is awarded/settled through the court/legal system. It sounds horrible to sue family/friends/neighbours, but that's basically the way is has to work in our society today. The insurance company wants legally documented proof and statements on any claims brought against the owners/occupants/policy owners. It's a brutal way to drag out any accountability for what happened and hold back payment as long as they can. God Bless America and their way of Capitalism! *sarcasm* Most family will understand that's how it works, so don't be hesitant to file the lawsuit. It looks wrong, and appears unethical, but that may be the only way to get compensated by an homeowner.  
 
As for the policy holder on what happens after... They'll get screwed over like the rest of us when we make a large claim. Premiums will go up, coverage will dwindle or get eventually cancelled and they will have to try to find a better rate through someone else. ...Life will go on.  
 
I knew of a family that had to go through it. It sounds worse then it is. Outsiders will make ill-informed opinions and that can/will happen. But people have to do it and go through it to appease the insurance company. No way of getting around that. If there is any bitterness held against anyone, it would be of the policy writers and the procedures required to help the ones that need assistance.

So you are saying I could steal someones vehicle, smash into someone else and come out a millionaire?? I know what I'm doing tomorrow!! I can't say what I want to on this topic because I will get kicked off Ebrandon AGAIN - I will just say our system is broken and that punk is lucky he wasn't sueing me!

Yes, ur comment about the "American way" is exactly right. They did call the insurance company and that's exactly what they said. Insurance will not pay out unless sued.  
My income will be affected. Not sure how long recovery could be. Can't expect family to pitch in and pay for my lost wages & costs of running for Dr appointments.  
It was an accident plain & simple. Family feels terrible it happened as well. ....is this not the entire point of having insurance? Do u think if i was out for blood i would be asking for ebrandon approval? Which i wasnt, i was asking for lawyer recommendation(Eros86-maybe u should give me ur lawyer name so I know who NOT to talk too cause it sounds like u got screwed!)  
I agree it sounds crazy! I also don't want to cripple the family financially by having their rates go thru the roof.

EI through your work you are entitled to 13 weeks of sick benefits. If it's longer than that then you can apply for CPP disability.

Your family member can help out with your out of pocket expenses rather than having them file through their insurance

Eros your story is crazy ridiculous! I can't believe that guy could get away with that. That's the kind of story you really should tell to a tv show someday. I'd be really curious to hear all the details exposed. Just galls me that someone can do that.

Hey, with your case. Did you happen to leave your car keys in your vehicle? And/or did you know the person who stole your vehicle? Those are scenarios where I think your story is true. Hard to believe that all happened because someone hot wired your car and did all that. This is my opinion. If they did straight up hot wire your vehicle and did that all that. Then yes we do live in a messed up world. If the things I said first in my post are true though. I can understand how all that happened to you. Its hard to sue in Canada though isnt it?
