smoking and rentals

I have been looking for a place to rent recently and have not had much luck. I have been able to find some nice apartments in my price range but things always go south as soon as i read "NO SMOKING".
My question is: can a rental owner leagally addvertise an apartment as "Non-smoking"?
I ask this cause I have spoke with other landlords and rental property managers who say they don't understand how so many people get away with it. A lifestyle choice as they put it.
Anyone have a clear understanding of the law here?
Side note:
This is not a thread about me not owning my own home and if i don't like the rules people set that i should go out and buy myself a home ok!
