NO SMOKING at Home?

Smoking is being banned all over lately - from offices, restaurants and bars to parks and beaches. And soon, the right to smoke in your own apartment could be gone, too.
Back in 2006, the city of Belmont, California, outlawed smoking in apartments and condos with shared floors or ceilings. Then, in 2007, two New York City condo owners sued their neighbor for lighting up in her apartment and "causing smoke to enter into the common hallway." And, in Dallas, a woman is suing for property damage she says was caused by cigarette smoke wafting through the adjoining walls of her townhouse. Non-smokers in these cases could be covered by the Americans with Disabilities Act, but only if the cigarette impairs a major life function.
A court order not to smoke in your own home might sound outrageous, but then again, so is having to smell someone else's cigarette smoke in your apartment.
Should people be allowed to smoke in their own homes if it means the smoke could drift into other peoples' living spaces?
