Yep, a lot of questions for a cookie. Because there are public health rules depending on where you are selling items.  
 
If you are selling them at a Farmer's Market or Bake Sale, these rules apply (and you couldn't sell items made with dairy, meat, poultry, or poultry products which I think includes Whoopie Pies):

If you are selling them 'to whoever would buy them', that's a business. Unless you have access to a commercial kitchen, you can't sell anything:
