I was just looking through the apartments and so many say non smokers only. This is discrimination at its finest. I believe we all have human rights and to discriminate because someone smokes is distasteful and also against our human rights. I agree that apartments should be non smoking but if smokers are going outside why do they care so much? Do we not have any freedoms left?

I'm not saying everyone does it but I know a lot of people who smoke in non-smoking places. It's a big risk you add in the fact that the smell will linger and get into everything eventually it's not surprising that it's a trend. And the final point to this is, it's their property they can let only who they want to live there.

maybe try be a landlord situation: some tenants are allergic to smoke so that eliminate good tenants for landlord to have unless the suite/house gets all cleaned which cost quite bit of money so really because are discriminating or racism in any way so goes the same for no pets. It does cost money to clean up a premises for either smoke or pet smell for allergic people.

Where does it say that it is discriminating against smokers? It is a smoke free building or unit. Have you ever cleaned a unit after a smoker. I rented a MB housing unit for a couple years. My daughter got sick and I put in one of those warm mist humidifiers and the yellow that oozed from the walls, blinds, etc was disgusting. My ex's mother had her couch moved in the living room. It stuck to the wall and you could see the outline of where it was. Smoking does a lot of damage to a unit smokers don't realize. Nothing wrong with wanting smoking outside, no different than a bar or food establishment.

Smoking is not a necessity, and it can damage an apartment very badly. Just like having pets is not a necessity, and they can cause damage to an apartment. It's up to the landlord whether they allow this in their building or not.  
 
We have had tenants the cook a certain way, leaving it very very difficult to get smells out of the place, just like smoking, but you can't stop someone from eating, because it is a necessity. Those types of things are not up to the landlord. A line has to be drawn somewhere on what discrimination is, and not allowing a person to smoke on your property is not discrimination.

The Human Rights Code, which is the Act that states what discrimination is and isn't for non-government entities or persons reads as follows:  
 
9(1.1) In this Code, "discrimination" includes any act or omission that results in discrimination within the meaning of subsection (1), regardless of  
 
(a) the form of the act or omission; and  
 
(b) whether the person responsible for the act or omission intended to discriminate.  
 
Applicable characteristics  
 
9(2) The applicable characteristics for the purposes of clauses (1)(b) to (d) are

Last time I checked, smoking doesn't fall into these categories.  
 
Just because you want to smoke, doesn't mean everyone has to support that decision.

Non smokers only. Even if you are a smoker and plan to smoke outside they will not rent to you. I have an apartment so im not looking but it bugs me that they wont allow smokers. It is discrimination and it is against the law. Weather its their property or not to say no smokers only then its discrimination.

There's a difference between discrimination & doing what's best for your property now & for the future. Discrimination is generally reserved for things you can't help about yourself, like skin colour, eye cold etc...Many would argue smoking is a choice.  
 
There is no human right to smoke. If there was, there would also be a human right to not be subjected to the smell of smoke.  
 
Many smokers have ruined it for you by not respecting rules and smoking inside when they weren't supposed to. Get mad at them, not the guy trying to protect his property.

The act outlines the grounds on which it is prohibited to discriminate.  
 
If a landlord wanted to discriminate on the basis of, say, no Calgary Flames fans in their building, or no Winnipeg Blue Bombers fans, or people with house plants, that is not prohibited.  
 
It may be discriminatory to refuse to rent to smokers, but that is not prohibited grounds, so it is not in contravention to the act.

This site goes into it further. We have freedoms. This is the same thing as saying no children in the apartments.  
 
I took some courses and the human rights commissioner came and spoke with us about our rights. This was part of the discussion

People think they are entitled to everything. Smoking in an apartment owned by somebody else is not a human right. Quit smoking or quit complaining.

I'm not saying that I necessarily agree with the RIGHT to smoking inside, but wouldn't it technically fall under the 'disability' portion of this? Wouldn't a tobacco dependency qualify because it is absolutely an addiction?

Although nicotine addiction may be considered a disability, smoking is not the only way to satiate that addiction. Addicted folks can use nicorette gum, patches, or even e-cigs to get their fix.  
 
Just because you don't smoke inside doesn't meant the smell doesn't permeate everything you own. Last week I had a conversation with someone who evidently is a heavy smoker. He wasn't smoking at the time, but oh man did the smell follow him. I nearly hurled in his face and couldn't end the conversation quickly enough.

We have some apartments and prefer non smokers - even if they smoke outside. Winter time they tend to smoke inside and if they are outside the number of cigarette butts laying around is not acceptable. Cleaning of one smoked in apartment cost us several hundreds of dollars in cleaning, cleaners, paint & painters - more than the damage deposit.

Smoking in an apartment. A landlord has every right to not let someone smoke inside their building. Im talking about not renting to anyone who is a smoker even if they smoke outside.

Are technically a commercial building so it would therefore be illegal to smoke in. Besides noones wants to smell ur stinky ass smoke. No apartment owner wants to pay to re-drywall and carpet an apartment because u were to much of a lazy ass to walk outside to have a smoke. Its not discrimination, just good management skills. Maybe think about the other ppl who dont smoke and dont want to smell ur stinky habit.

Are no laws against smoking outside.

I asked you where smoking fits into that list. Smoking falls under none of those categories.

First of all, "smokers" are not a protected class, so discrimination is not an issue.  
As long as they don’t discriminate based on prohibited grounds, landlords can basically choose whomever they want. For example, a landlord can refuse to rent to smokers or disallow pets because smokers (and pet owners) as a group are not protected by antidiscrimination laws.

Nicotine is a drug, smoking is not.

That's just awesome. Its ok to be a crackhead and rent the apartment, but cannot rent to a smoker who is willing to smoke outside of the apartment. Sounds about right.

It's really none of the landlord's business whether you smoke or not. You also don't have to disclose that information to them, but just don't smoke on the property and dispose of your butts properly.  
 
I've had neighbours that smoke and I've left home with the windows open, and I've come home to a house smelling of cigarettes. It's not pleasant at all, especially with kids in the house.  
 
Clean air is a basic thing we need to survive. Smoking contaminates the air and causes discomfort and sickness to the people subjected to inhale secondhand smoke. It isn't always in a person's power to avoid secondhand smoke. For example, drivers that are smoking and driving drive past me while I'm walking or biking and I inhale their smoke. I can smell it. People stand on the sidewalk and I have to walk past them. I inhale the smoke. I think smoking is highly inconsiderate since we know the harm it does to a person and the public cost of health care for cancer and lung disease treatments.

Careful you don't fall off of your high horse there. You are saying you are upset that people smoke in their cars and drive by you. you might just want to stay in you house because the exhaust coming from that same car is probably going to do you more harm... you best bubble wrap yourself and stay inside you house with a air purifyer and the windows closed if you are upset by something like that.

When you smoke ( even outside) that is absorbed into everything and i mean everything. All your hair, hands, skin, cloths everything smells. As a smoker you wont notice that but non smokers do and it can be very strong. That smell will carry all around with you and will then cause the apartmentcondo to smell too. So as a landlord that doesn't want to pay fees to clean up the smell of something that is done at a person's will makes sense. Its not like its a fee to do something mandatory like install an AC to live comfortably, or fix a breaker that is faulty to prevent a fire. They are paying to clean a very tough smell that someone created because they taken up smoking.  
 
Go to restaurants, all smoking sections in this day and time have been removed. It is so much of a hassle to try and separate smokers and nonsmokers in the same building. It is easier to just eliminate from the building the thing the majority of people don't do-smoke.  
 
You chose to start smoking, it's not like you were born smoking straight from the womb, it's not a disability, it's not a right. It's a choice you make. With that choice you would have noticed how many commercial buildings do not allow smoking inside them. This is no different. So by yelling out that it is discriminatory or unjust treatment is just selfish.  
 
Either get a house or find a smoke friendly building and have whatever smoking product your heart desires
