And..this is what is wrong with our justice system.  
 
A 16 year old, highly intoxicated smashes out the window of a police service vehicle.  
 
A 16 year old is a juvenile, while at 18 he would be considered an adult. I think every 16 year old would be old enough to know what is wrong with this.  
 
But he is released and due in court at a later date...really, throw him in jail and let him see what it is like. This can only be the start of many charges "in my opinion" for this young man.

cannot just throw him in jail. Several reasons for this. Does he meet the requirements to keep him in custody? Likely NOT therefore he, by law of the criminal code must be released on a promise to appear with conditions or an appearance notice to attend court at a later date. There are a set of criteria that must be met in order to hold him in custody; not just because he "should" be or said officer "wants" him to be held.

I agree with Oryx. You can't just throw them in jail, LOL. There's due process.  
 
Also, you're making a lot of assumptions about this kid. According to the article you linked to, it's unknown if the kid was ever in trouble before, has a history with the police, is in a group home or living with parents, etc. It could have been his 100th time in trouble, but just as easily been his first.

glad that we cannot just throw people in jail. Could you imagine if an officer didn't have a good feeling about an accused or they were awful to deal with .... well off to jail they go... very subjective. Of course there is a process that all officers must follow which is outlined explicitly in the criminal code of Canada.

Not only this story, but many others see these officers go through so many situations and the hard eveidence is there, but they are released and either do not appear, are repeat offenders or get a slap on the wrist.  
 
Must be very demoralizing at times for the police officers.

I agree there needs to be better justice but jail immediately is not the answer. But our justice system needs an overhaul. I work in retail and the amount of theft is ridiculous to the fact that I’m afraid someone will get seriously hurt soon. By the age of 10 (if not earlier) anyone should no right from wrong.

I don't care where, who he lives with or if he has or has not been in trouble before - and I never said he was.  
 
He is 16 - he can get a license, seems to know how to get drunk, cause damage. The justice system needs to make sure he is charged appropriately.  
 
My statements also refer to the many you hear of getting a slap on the wrist for criminal activity, not just this kid.  
 
It just keeps on getting worse and worse.  
 
too bad my statement about throwing him in jail was not taken as a "gee I wish they could do that"

The issue is how to fix the problem. Do you fix the problem by throwing a kid in jail over a $200 window? Professional help would be better. Assign a person with problem solving skills. Every kid does dumb things.  
 
Besides do you know the kid’s situation? What have they experienced to be at this point in life?

I am so tired of hearing about peoples situations made them do this, that,or contributed to their current life path. You are old enough to know better so you should be held responsible. If your situation is negative than do something to change it. Plenty of help out there, find it!

This is a property crime, in all likelihood born of the emotion of the immature. It's about money. My question is this? over the course of your life who have you lost more to, the proverbial 16 to 25 year old criminal or the man in the suit. Most respond the man in the suit. Then why is it so many waste there time vilifying the the 16 to 25 year old and not the man in the suit who plots to take you. The assault on the vehicle was senseless, fraud is not and generally never punished. I could be wrong.

If it is a 16 or 24 year old or some old dude on a suit- If they rob me of.sometujng or if they vandalize my property, I am going to go after them. I do not care how miserable their life may be, how hard done by they are in life, ma y ot is overdo.e hardships to get where we are in life and I am Tired of some using the excuse that their situation drove them to their life of crime. Some pink vandalized someone else's property and gets caught-he should have to pay restitution.

well, we had someone damage our property. She was caught, went to court, plead guilty and had to pay restitution.  
 
That was about 8 years ago, we got a letter she got an extension on payment and that is the last we ever heard.  
 
So, nothing really happened to her. She had no job, we could not garnishee wages, etc.

As someone who is that age SHOULD know right from wrong, they don’t seem to comprehend it, they say that mentally the frontal lobe doesn’t fully develop into maturity till about age 25 or later, this coupled with no teaching about the difference between right and wrong, poses a problem and this is not me standing up for this person, cause I think he’s a complete idiot, That lacks respect, I’m just exploring different avenues, that someone this young hasn’t had either the leadership to know the difference and is making immature choices based on brain development.
