If this Amazing position is for a non custodian house hold member. He/she may need to move and accept the position.
Good chance for the person to get settled in the job and find appropriate housing.
The custodial parent and children will need to remain here until your court case can be heard.
You may have grounds to move based on numerous factors. To name a few......
If you two are married/common law.
The job is main income for the family.
I believe you may need to provide a plan as to how your children will stay in contact and have enough visitation with your ex.
Maybe if you have a decent detail plan of visitation and phone contact. Who pay for the transportation of the children. etc...to present your ex he/she may reconsider their original no.
Perhaps you could make a temp agreement for your ex to temporary keep the children. until your court date is set up. or until summer break from school. Then you would be free to leave and get things set up for the children, housing, school, daycare etc...
Not the best of situations but as you must know by now the courts can be a very slow process.
